• 摘要： 作为法律形式的法典并不是诞生于现代社会，它在古代社会早已有之。历史法学派巨擘亨利·梅因曾经从法律演化视角深入研究过古代和现代法典。概言之，古代法典与现代法典在法源、体例、分类和实质精神方面具有显著差异。更重要的是，从法律演化的视角看，古代法典象征着初民社会法律的终结，而现代法典则象征着从传统向现代法律的跨越。
• The Code, as a legal form, was not born in modern society, which in fact has existed in ancient society. Henry Maine, one of the authority on Historical Jurisprudence, had lucubrated ancient and modern codification. In general, there are significant differences between ancient and modern codification in the aspects of source, form, classification and spirit. Most importantly, from the perspective of legal evolution, ancient code stands for the end of law of primitive law, and modern code signifies transformation from tradition to modern law.
