The Code, as a legal form, was not born in modern society, which in fact has existed in ancient society. Henry Maine, one of the authority on Historical Jurisprudence, had lucubrated ancient and modern codification. In general, there are significant differences between ancient and modern codification in the aspects of source, form, classification and spirit. Most importantly, from the perspective of legal evolution, ancient code stands for the end of law of primitive law, and modern code signifies transformation from tradition to modern law.
