• 摘要： 新修改的著作权法第八条对于著作权集体管理制度内容进行了新增扩充，新增条文是对当前实践层面存在的问题所作出的积极回应，赋予了著作权集体管理组织一定的法律权利及义务。但针对著作权集体管理制度的立法设计与实践层面的不匹配依然是一个突出的问题，因此需要厘清著作权集体管理制度本身的本土价值定位，为之后著作权集体管理制度的发展指明方向，最大化的发挥该制度的本身效用。
• Article 8 of the newly amended Copyright Law adds and expands the content of the copyright collective management system.
