论中国特色体育仲裁制度的建构

• 摘要： 按照惯例，2022 年冬奥会期间，国际体育仲裁理事会将在中国设立国 际体育仲裁院奥运会特别分院以解决纠纷，但我国体育仲裁制度尚未建立，国 际社会通行的体育纠纷解决方式——仲裁在我国并不“通行”。体育仲裁机制 长期缺位对有效化解体育纠纷、促使我国体育事业不断国际化极为不利。因此， 基于我国“举国体制”的竞技体育发展现状，融合时代特色、实际特色，关注 法律移植、立足整体，建构独具中国风格、饱含中国特色的体育仲裁制度。
• According to the convention, the 2022 Winter Olympics period, International Council of Arbitration for Sport will set up Olympic Games Ad Hoc Division in China to resolve disputes. But the sports arbitration system has not been established in China, and the common way of resolving sports disputes in the international community is not “popular” in China. The long-term absence of sports arbitration mechanism is very unfavorable for effectively resolving sports disputes and promoting the internationalization of our sports cause. Therefore, in consideration of the sports developing status under the “Whole-nation System”, integrating the characteristics of the times and the actual characteristics into the sports arbitration system, paying attention to the legal transplantation, and based on the legal system, construct the sports arbitration system with Chinese style and Chinese characteristics.
