• Abstract: 随着我国法治建设的不断深入，民事诉讼制度在保障公民合法权益方面发挥着越来越重要的作用。然而，滥用诉权、重复起诉等问题屡禁不止，不仅浪费了有限的司法资源，也对司法公正和效率造成了严重影响。诉权滥用的成因是多种多样的，主要成因是诉讼费用低导致违法成本低，且我国现行的民事诉讼法律并未对滥用诉权进行直接规制，本文旨在综述当前国内外关于滥用诉权的个案识别，通过案例分析，借鉴域外经验，完善民事诉讼法中关于诉权滥用的规定，明确滥用诉权的构成要件、认定标准和法律责任等。
• With the continuous development of the legal construction of our country, the civil procedure system plays an increasingly important role in guaranteeing the legal rights and interests of citizens. However, the abuse of the right of action, repeated prosecution and other problems are repeated, which not only wastes the limited judicial resources, but also has a serious impact on judicial justice and efficiency. The causes of the abuse of litigation right are various, and the main cause is that the low litigation cost leads to the low illegal cost, and the current civil procedure law in China does not directly regulate the abuse of litigation right. This paper aims to summarize the current case identification of the abuse of litigation right at home and abroad, and improve the provisions on the abuse of litigation right in the civil Procedure Law through case analysis and learning from foreign experience. Make clear the constituent elements, identification criteria, legal liability and so on of abuse of suit right.
