论诉讼离婚冷静期的必要性

• 摘要： 自《民法典》正式规定登记离婚冷静期以来，离婚自由与社会稳定性的关系受到越来越多的关注，登记离婚冷静期与诉讼离婚冷静期之间的问题也逐渐显现，是否有必要专门关注与研究诉讼离婚冷静期成为其中首要的问题。登记离婚冷静期与诉讼离婚冷静期虽然目的都是为了平衡离婚自由与社会稳定性之间的关系，但各自有着不同的功能。登记离婚与诉讼离婚面临的问题不同，这也导致各自需要设立针对自身问题的完善的离婚冷静期制度。重视和完善诉讼离婚冷静期，才能从整体上完善我国离婚制度，提升人民离婚满意度，进而提升人民婚姻满意度。
• Since the Civil Code officially stipulated the cooling-off period for registered divorce, more and more attention has been paid to the relationship between the freedom of divorce and social stability, and the problem between the cooling-off period for registered divorce and the cooling-off period for litigated divorce has gradually emerged. The cooling-off period for registered divorce and the cooling-off period for litigated divorce both aim to balance the relationship between divorce freedom and social stability, but they have different functions. The problems faced by registered divorce and litigation divorce are different, which also leads to the need to set up a perfect divorce coolingoff period system for their own problems. Only by paying attention to and improving the cooling-off period of litigation divorce can we improve our divorce system as a whole, enhance people’s divorce satisfaction, and then enhance people’s marriage satisfaction.
