Since the Civil Code officially stipulated the cooling-off period for registered divorce, more and more attention has been paid to the relationship between the freedom of divorce and social stability, and the problem between the cooling-off period for registered divorce and the cooling-off period for litigated divorce has gradually emerged. The cooling-off period for registered divorce and the cooling-off period for litigated divorce both aim to balance the relationship between divorce freedom and social stability, but they have different functions. The problems faced by registered divorce and litigation divorce are different, which also leads to the need to set up a perfect divorce coolingoff period system for their own problems. Only by paying attention to and improving the cooling-off period of litigation divorce can we improve our divorce system as a whole, enhance people’s divorce satisfaction, and then enhance people’s marriage satisfaction.
