论大数据杀熟中的消费者权益保护

  • 摘要: 随着大数据技术、人工智能技术的发展,人们的生活更加便利。经营者通过大数据的统计,可以轻易推断出消费者的喜好,购买力等其他重要信息,从而对不同的消费者进行区别定价,这就是近年来出现的“大数据杀熟”问题。本文从保护消费者权益的角度出发,明确“大数据杀熟”的概念,正视消费者权益受到的损害,分析大数据杀熟损害消费者利益的原因,提出了可能的权益保护办法。总之,消费者权益的保护离不开法律的规制和消费者的努力,遏制“大数据杀熟”现象势在必行。
  • With the development of big data technology and artificial intelligence technology, people’s life is more convenient. Through the statistics of big data, operators can easily infer the preferences of consumers, purchasing power and other important information, so as to discriminate the pricing of different consumers, which is the “big data kill mature” problem in recent years. From the perspective of protecting the rights and interests of consumers, this paper clarifies the concept of “big data kill cooking”, faces squarely the damage to the rights and interests of consumers, analyzes the causes of big data kill cooking damage to the interests of consumers, and puts forward possible rights and interests protection measures. In short, the protection of consumer rights and interests cannot be separated from legal regulation and consumer efforts, and it is imperative to curb the phenomenon of “big data kill cooking”.
