- Abstract: 我国《个人信息保护法》已明确规定数据可携权，但是距离个人具体应用该项权利还有许多问题值得探讨。从权利主体的角度出发，法人是否可以代理数据可携权尚不明确；再从权利客体的角度来看，涉他数据是否可以适用数据可携权亦需考虑。本文将从法律规则出发，为解决上述两个问题提供一些个人浅薄的思考。
- Personal Information Protection Law has clearly stipulated the right to data portability, but there are still many issues to be discussed before individuals can specifically apply this right. From the perspective of the subject of the right, it is not clear whether a legal person can act as an agent for the right to data portability; from the perspective of the object of the right, whether the right to data portability can be applied to data involving others also needs to be considered. This article will start from the legal rules and provide some personal superficial thoughts on solving the above two problems.
