论对家事案件合并审理程序的完善

• 摘要： 家事案件的处理往往涉及与同一基础事实或身份关系相联系的多个家庭成员或多种家庭纠纷，为兼顾家事案件的特殊司法价值与彻底解决家事纠纷的目的，应当对不同类型家事案件合并审理。然而由于我国缺乏对处理家事案件的具体规定以及配套的系统性非讼程序规定，为进一步完善我国合并审理家事案件的程序，应当构造一套体系化的程序适用模式来对数件家事案件的合并审理进行规制。本文先将合并审理的家事案件按照程序类型进行分类，再对不同类型的案件应当适用的具体程序进行分析，以此方式对合并审理家事案件的程序提出完善建议。
• The handling of family cases often involves multiple family members or multiple family disputes related to the same basic facts or identity relationship, in order to balance the special judicial value of family cases with the aim of thoroughly resolving family disputes, different types of family cases should be tried together. However, due to the lack of specific provisions for dealing with family cases in our country and the supporting provisions of systematic non-litigation procedures, in order to further improve our combined trial procedure of family cases, we should construct a set of systematic procedure applicable mode to regulate the amalgamation of several family cases. This paper first classifies the family cases tried jointly according to the types of procedures, and then analyzes the specific procedures that should be applied to the different types of cases, in this way, the author puts forward some suggestions to improve the procedure of hearing family cases.
