Research and Reflection on the Thinking of Court Judgment in Shareholder Identity Negative Confirmation Litigation —From the Perspective of Bankruptcy Derivative Litigation
In the context of the corporate capital subscription system, the liquidation of external debts will result in legal actions to recover shareholders’ unpaid capital contributions or withdraw their capital contributions. These legal actions for recovery may lead to corresponding civil or administrative litigation aimed at confirming shareholders' identities. This paper summarizes the court’s perspective on such litigation and concludes that greater attention should be given to presenting evidence in these cases. Additionally, the author proposes improvements regarding business registration implementation for market subjects to prevent identity fraud issues under registration scrutiny.
