对我国目前个人信息知情同意权缺陷的思考

• Abstract: 知情同意，又被称为告知同意，是指信息处理者在处理个人信息时，需要个人知情并同意。欧盟一般数据保护条例（GDPR）和我国《民法典》《个人信息保护法》《网络安全法》都对此有相应的规定。目前我国互联网应用平台在个人信息知情同意权的构造和运用上存在诸多缺陷。本文从裁判文书和6个常用App的《隐私政策》出发，进行对比研究，发现我国目前个人信息知情同意权的一些缺陷，并提出相关建议与措施。在互联网时代，必须从实际出发，认识和平衡个人信息权的保护和发展互联网的矛盾，促进社会的进步与发展。
• Informed consent means that the information processor needs personal knowledge and consent when processing personal information. The EU General Data Protection Regulation (GDPR) and China’s Civil Code, Personal Information Protection Law and Network Security Law all have corresponding provisions for this. At present, there are many defects in the construction and application of the right of informed consent of personal information in China’s Internet application platform. Starting from the judgment documents and the Privacy Policies of 10 commonly used apps, this paper conducts a comparative study, finds the defects of the current right of informed consent of personal information in China, and puts forward relevant suggestions and measures. In the Internet era, we must proceed from reality, understand and balance the contradiction between the protection of personal information right and the development of the Internet, and promote social progress and development.
