Informed consent means that the information processor needs personal knowledge and consent when processing personal information. The EU General Data Protection Regulation (GDPR) and China’s Civil Code, Personal Information Protection Law and Network Security Law all have corresponding provisions for this. At present, there are many defects in the construction and application of the right of informed consent of personal information in China’s Internet application platform. Starting from the judgment documents and the Privacy Policies of 10 commonly used apps, this paper conducts a comparative study, finds the defects of the current right of informed consent of personal information in China, and puts forward relevant suggestions and measures. In the Internet era, we must proceed from reality, understand and balance the contradiction between the protection of personal information right and the development of the Internet, and promote social progress and development.
