审判团队与审判庭的关系平衡问题研究

• 摘要： 审判团队作为法院内设机构改革下新设的办案单元，是落实司法责任制与完善审判权运行机制、提高审判质量效率的创新举措。作为改革的新兴产物，审判团队运行至今积累了很多宝贵经验，但也在和审判庭关系方面产生了不少问题。本文拟从审判团队的实践困境、原因分析、关系重塑、制度构建等方面对科学的审判团队运行模式进行分析讨论。
• The trial team, as a newly established case handling unit under the reform of the internal structure of the court, is an innovative measure to implement the judicial responsibility system, improve the operation mechanism of judicial power, and improve the quality and efficiency of trials. As an emerging product of reform, the trial team has accumulated a lot of valuable experience in operation, but it has also caused many problems in its relationship with the trial court. This article intends to analyze and discuss the scientific operation mode of trial teams from the aspects of practical difficulties, cause analysis, relationship reshaping, and institutional construction.
