网络民意与司法的法经济学研究 ——比较法视野中的江歌案和药家鑫案

• 摘要： 江歌案的一审判决将道德维度引入法律方法，用法教义学接受的解释办法得出符合舆情的方案。网络舆论的言论具有“道德意识”和“非专业性”两点特征，因此对司法裁判产生的影响也具有优劣：从道德的角度促使判决“法”与“情”相融合实现实质正义；“非专业”民众对司法判决造成巨大压力。通过引入法经济学成本-收益分析方法，比较我国司法机关在江歌案与药家鑫案这类引发广大网络民意的案件对司法裁判的影响与美国最高法院面对与公众意见相悖的裁决时的舆论规制途径，并探寻我国司法受到网络民意影响的根本原因，提出解决对策。
• The first instance judgment of the Jiang Ge case introduced the moral dimension into thelegal method, and used the interpretation method accepted by the doctrine to reach a plan in line withthe public opinion. Network public opinion has two characteristics of "moral consciousness" and "nonprofessional",so it also has advantages and disadvantages on judicial judgment. From the perspective ofmorality, it promotes the integration of "law" and "emotion" in judgment to realize substantive justice;"Non-professional" people put enormous pressure on judicial decisions. By introducing the cost-benefitanalysis method of law and economics, this paper compares the influence of Chinese judicial organson judicial adjudication in cases such as Jiang Ge case and Yao Jiaxin case, which triggered widespreadInternet public opinion, with the ways of public opinion regulation of the US Supreme Court when facingrulings contrary to public opinion, explores the root causes of the influence of Internet public opinion onChinese judiciary, and puts forward solutions.
