• 摘要： 随着新时代社会整体环境复杂化、人员类型多元化以及生活方式的集合化，社会纠纷日益增多，由此导致的各种社会问题日渐突出。同时伴随着人民法律意识的不断加强，法院的案件骤增，“案多人少”已经成为法院工作的常态化现象。至此作为非诉解决纠纷和诉源治理的重要手段——人民调解制度已经到了做出适时性改革的时刻。为了维护整个社会的和谐安定，从而达到真正的定分止争，或可从人民调解组织的构成主体、调解模式、调解技巧等不同方面对其进行改革，提高人民调解的专业化程度，促进行业调解的发展，实现当事人调解的自愿性、调解结果的可接受程度和调解协议可执行性的有机统一，使人民调解制度真正成为保障人民群众合法权益的第一道柔性防线和维护社会大团结的重要机制。
• With the complexity of the overall social environment in the new era,the diversity of personnel types and the integration of life style, social disputesare increasing day by day, resulting in a variety of social problems increasinglyprominent. At the same time, with the continuous strengthening of people’s legalconsciousness, the number of court cases has increased rapidly, “more casesless” has become the normal phenomenon of court work. So far, the people’smediation system, as an important means of non-litigation dispute settlementand litigation source governance, has come to make timely reform. In order tomaintain the harmony and stability of the whole society, so as to achieve a realsettlement and end disputes, it may be possible to reform people’s mediationorganizations from different aspects such as the composition of the main body,mediation mode, mediation skills, improve the degree of specialization ofpeople’s mediation, promote the development of industrial mediation, To realizethe organic unity of the voluntary mediation of the parties, the acceptability ofthe mediation results and the enforceability of the mediation agreement, makethe people’s mediation system truly become the first flexible line of defenseto protect the legitimate rights and interests of the people and an importantmechanism to maintain social unity.
