监察委技术调查官的设立与完善初析

• 摘要： 由于贪污贿赂犯罪特殊性，技术调查措施作为一种调查手段具有不可比拟的优势。但目前的技术调查权力分散、效率低下、程序混乱，制度性和体系性不强，监察技术调查权明显呈现出一体化乏力导致的反腐效率不足的窘态。在监察委内部设立技术调查局，组建专门的监察技术调查人员，采用内部权力分立。比照司法令状形式，由专门的技术调查监察官充当“司法官”对技术调查进行审批，使监委技术调查更具程序性和法治化，从而构建监察权一体化的权力形式。
• Due to the particularity of corruption and bribery crime, technicalinvestigation measures as a means of investigation have incomparableadvantages. However, the current technical investigation power is scattered,low efficiency, chaotic procedures, institutional and systematic system is notstrong, and the supervision technology investigation power obviously shows thelack of anti-corruption efficiency caused by the lack of integration. A technicalinvestigation bureau shall be set up within the supervisory commission, andspecial supervisory technical investigators shall be set up to adopt internalseparation of powers. According to the form of the judicial writ, the specialtechnical investigation supervisor acts as the “judicial officer” to examine andapprove the technical investigation, so that the technical investigation of thesupervisory commission is more procedural and ruled by law, so as to build thepower form of the integration of the supervisory power.
