中国古代“恤幼”思想对当代未成年人刑事政策的借鉴与启示

• Abstract: 中国古代刑事政策受多元化思想的影响，其中影响最大的是儒家思想，而“恤幼”思想就是儒家思想的体现之一。“恤幼”思想是对未成年人犯罪实施一种特殊的宽宥政策，主要体现立法和司法之中，即不同的刑事责任年龄所承担的刑事责任不同，在刑事处罚中也给予未成年人更多轻缓化的措施等。古代“恤幼”思想对现在的未成年人犯罪刑事政策和预防措施具有一定的借鉴意义和启示。因此，在借鉴古代“恤幼”思想的基础上，进一步完善未成年人犯罪的刑事政策，既有利于充分发挥刑事政策对刑事立法、刑事司法的指导和补充作用，又有利于惩罚和预防未成年人犯罪，在最大程度上保障未成年人的合法权益。
• Criminal policies in ancient China were influenced by diverse ideas,with Confucianism being the most influential, and the idea of “caring for theyoung” is one of the manifestations of Confucianism. The idea of “caring forthe young” is a special leniency policy implemented for juvenile delinquency,which is mainly reflected in legislation and justice. Different ages of criminalresponsibility bear different criminal responsibilities, and more lenient measuresare also given to minors in criminal penalties. The ancient idea of “caring forthe young” has certain reference significance and inspiration for the currentcriminal policies and preventive measures for juvenile delinquency. Therefore,on the basis of drawing inspiration from the ancient thought of “caring for theyoung”, further improving the criminal policy of juvenile delinquency is notonly conducive to fully exerting the guiding and supplementary role of criminalpolicy in criminal legislation and criminal justice, but also conducive topunishing and preventing juvenile delinquency, and safeguarding the legitimaterights and interests of minors to the greatest extent possible.
