宽严相济刑事司法政策下妨害传染病防治罪之立法完善路径研究

  • 摘要: 政策的制定与落实中离不开法律的支持与保障,刑事政策在刑事立法、司法、执法中发挥着重要的灵魂指引作用。近年来,由于新型冠状病毒在全球范围内肆虐,面对社会公共法益的保护需求,妨害传染病防治罪作为与公共卫生安全具有紧密联系的重要罪名之一,在此期间被重新激活并在司法实践中根据具体实际情况进行了进一步解释与适用。妨害传染病防治罪经过多年的立法完善与治理经验积累,在宽严相济的刑事政策指导下,做到了对惩治此类犯罪的“该宽则宽,当严则严,宽严相济”,实现了保障公众权益与个人自由的最大法律效益。
  • The formulation and implementation of policies cannot be separatedfrom the support and guarantee of laws. Criminal policy plays an importantrole in criminal legislation, judicature and law enforcement. In recent years, dueto the global ravages of the novel coronavirus, the crime of interfering with theprevention and treatment of infectious diseases, as one of the important chargesclosely related to public health security, has been reactivated during this periodand further interpreted and applied in judicial practice according to the actualsituation. After years of legislative improvement and management experienceaccumulation, and under the guidance of the criminal policy of combiningleniency with severity, the crime of hindering the prevention and treatment ofinfectious diseases has been punished with "leniency when necessary, stricenesswhen necessary, and leniency with severity", realizing the maximum legalbenefit of protecting public rights and individual freedom.
