论风险社会下的行政诉讼受案范围

• 摘要： 伴随着后工业时代的来临，科学技术不断进步的当下也可能面临其他风险所带来的危机。从夜警国时代到法治国时代再到福利国家时代，政府的职能从创造性的社会管理活动转变到了以风险预防为主的社会管理。前者针对的是既定状况下的管理活动，后者针对的是未来的、可能的、预防性的管理活动，充满着不确定性和突发性。在此情景下，原有的行政诉讼受案范围已不能满足风险社会的现实需求，如何更好地保护公民的救济权益成为了当下必须回应的问题。本文拟从风险社会的背景出发，阐述风险社会下公民权益受损的现状进而研究行政诉讼受案范围的变化。
• With the advent of the post-industrial era, the continuous progressof science and technology may also face other risks brought about by the crisis.From the era of the night police to the era of the rule of law to the era of thewelfare state, the function of the government has changed from creative socialmanagement activities to social management focusing on risk prevention. Theformer is aimed at the management activities under the established situation,while the latter is aimed at the future, possible and preventive managementactivities, full of uncertainty and suddenness. Under this situation, the originalscope of administrative litigation can no longer meet the realistic needs of therisk society, how to better protect the citizens’ relief rights and interests hasbecome a problem that must be responded to at present. From the backgroundof the risk society, this paper expounds the status quo of the damage of citizens’rights and interests in the risk society and then studies the changes in the scopeof accepting administrative litigation cases.
