As an important support for blockchain technology, virtual currency
presents a diversified development trend in the context of the rapid development
of blockchain technology, and the criminal illegal phenomenon of virtual
currency is prominent. At present, the academic community has not yet formed
a unified view on the legal attributes of virtual currency. The establishment of
the legal attributes of virtual currency is the basis for the criminal regulation of
the theft of virtual currency. Virtual currency has property properties and can
be interpreted as property in the sense of criminal law. There are theoretical
and practical difficulties in regulating the theft of virtual currency by computer
crime. The punishment of the crime of theft on the basis of the property
attribute conforms to the subjective expectation of the perpetrator’s theft
behavior, and also meets the requirements of the principle of proportionality of
criminal responsibility and punishment, and at the same time protects the rights
of the victim. Using the average daily transaction price of virtual currency as the
basis for calculating the amount of theft, the standard is relatively determined,
and it is also in line with the protection of victims’ property rights.
