浅论法律逻辑的定位

• 摘要： 法律逻辑作为法律实践中极其重要的法学方法论, 我国的理论与实务界对其定位与研究方法都存在一定的争论。回顾了西方近现代法哲学界对法律与逻辑关系的探讨, 这些探讨, 特别是20 世纪70 年代以来在西方法哲学界所兴起的法律论证理论, 为中国法律逻辑的定位提供了新的视角与维度, 中国的法律逻辑应定位为法律论证的逻辑;20 世纪中后期在西方逻辑学界所兴起的非形式逻辑思想, 为中国法律逻辑的理论研究与实践提供了新的方法与理论基础。
• Legal logic as an extremely important legal methodology in legal practice, China's theory and practice circles on its positioning and research methods have a certain amount of debate. This paper reviews the discussion on the relationship between law and logic in the western legal philosophy circles. These discussions, especially the legal argumentation theories that have emerged in the western legal philosophy circles since the 1970s, provide a new perspective and dimension for the positioning of Chinese legal logic, which should be the logic of legal argumentation. In the middle and late 20th century, the non-formal logic thought emerged in the western logic field, which provides a new method and theoretical basis for the theoretical study and practice of Chinese legal logic.
