Abstract:
受疫情影响下的劳动合同履行不能的风险承担问题日益成为社会广泛关注的焦点。一方面,疫情防控措施影响下的用工关系不稳定性产生的风险将影响到社会经济的稳定发展;另一方面,如何合理分担疫情防控导致的用工风险负担才趋于公平也考验着社会治理者的智慧。本文聚焦于疫情防控背景下用工风险承担问题之研究,冀通过梳理立法、司法、行政等权力范式对于调整疫情风险下发挥的应有功能,结合疫情影响下劳动合同履行不能原因及风险类型,构建公共权力参与、用工主体和劳动者合理分担的用工风险承担机制,有效化解疫情及其防控措施对用工关系稳定性的影响。
