影视二次创作与版权保护之角力

The Game Between Movies & TV Plays Re-creation and Copyright Protection

• 摘要： 近年来，多股力量协同推进影视二次创作的繁荣，使其成为一种显著的文化现象。影视二次创作者并不是被动的观众，他们是故事建构的积极参与者，且在“权威”阐释行为之外生产流行文化意义。然而，影视二次创作侵权问题日益严重，引起各部门高度重视。媒体成为推动版权保护的重要力量，版权之争背后也是长、短视频平台的博弈。影视二次创作与影视原创并非零和游戏，需建立法律与技术二元版权治理体系，采用合理利益分配机制和科学有效的监管机制，完善版权社会共治体系。保护版权的同时也应给影视二次创作留下足够生存与创新 空间，进而实现互利共赢、协同发展。
• In recent years, several forces contribute to the boom of movies & TV plays re-creation, and make it a remarkable cultural phenomenon. The creators of movies & TV plays re-creation are not passive viewers, in addition, they play an active role in constructing the story and make means of pop cultural beyond interpretations of the authority. However, the right infringement in movies & TV plays re-creation is on the slide, which attract the attention of all departments. What’s more, the medium plays an important force in promoting copyright protection, in other words, the battle between long videos and short videos lies behind the game of copyright protection. Furthermore, it’s not a zerosum game between movies & TV plays re-creation and copyright protection. We should build up a binary joint governance model between law and technology, and adopt reasonable profit distribution mechanism to perfect the system of copyright. Moreover, it’s necessary to leave enough space for the creator of movies & TV plays re-creation when protecting copyright. Only in this way can we realize the goal of all-win in cooperation and coordinated development.
