审判中心视域下鉴定意见质证研究

• Abstract: 庭审实质化是“以审判为中心”的诉讼制度改革的重要内容，刑事案件中鉴定意见的有效质证将助益于庭审实质化的落实。由于立法中缺乏相关的质证规则、鉴定人出庭制度以及专家辅助人制度不完善，被告方的质证权得不到充分的落实，致使鉴定意见的质证流于形式。未来的司法实践中，进一步完善鉴定意见质证制度与庭审实质化的要求具有内在的一致性。推进鉴定意见的有效质证，需要有针对性地对相关制度加以完善，确保鉴定人出庭作证、明确专家辅助人的法律定位、完善交叉询问制度，实现对鉴定意见的有效质证。
• The realization of trial substantiation is the core of advancing the reform of trial-centered lawsuit system, Effective cross-examination of expert opinion in criminal cases will contribute to the implementation of it. Due to the lack of relevant cross-examination rules in legislation, the system of expert witnesses appearing in court and the system of expert assistants are not perfect. So that the defendant’s right of cross-examination is not fully implemented, and it will cause the cross-examination of the expert opinion to become a mere formality. In the future judicial practice, further improving the cross-examination system of expert opinions is intrinsically consistent with the requirements of the substantive trial. To promote the effective cross-examination of expert opinions, it is necessary to improve the relevant systems in a targeted manner to ensure that the appraisers testify in court, clarify the legal positioning of expert assistants, improve the cross examination system, and achieve effective cross-examination of expert opinions.
