从“智”“慧”两方面分析智慧司法体系建设

• 摘要： 智慧司法体系建设并不是笼统的将现代化信息技术运用到司法实践中，而是从智能化技术和智慧化管理两方面进行司法体系的建设。将“智慧”二字独立分析，“智”就是智能化技术，包括现在的人工智能、大数据、云计算等，可以帮助法官和律师更高效的处理案件；“慧”就是智慧化管理，涉及流程、信息共享、标准化等方面，能提高司法工作的质量和效率。在法治改革的背景下，以习近平法治思想为指导，将这两方面深刻融入，并彻底贯穿于整个司法体系的建设中，不仅要坚持习近平法治思想，还需从二十大报告中强调情理和法理恰当平衡，让人民群众感受到司法的公正，更能感受到司法的温度。
• The construction of the intelligent judicial system is not a general application of the modern information technology to the judicial practice, but the construction of the judicial system from the two aspects of intelligent technology and intelligent management. “Wisdom” word independent analysis, “wisdom” is intelligent technology, including now artificial intelligence, big data, cloud computing, etc., can help judges and lawyers to handle cases more efficiently; “wisdom” is intelligent management, involving process, information sharing, standardization and other aspects, can improve the quality and efficiency of judicial work. Under the background of the reform of the rule of law, guided by xi rule of law thought, into the two aspects deeply thoroughly throughout the construction of the judicial system, not only to adhere to xi jinping, under the rule of law thought, also need to be from 20 report emphasizes reasonable and legal appropriate balance, let the people feel the judicial justice, more can feel the temperature of the judicial.
