大数据赋能行政违法行为监督的汉阳实践

• 摘要： 近年来，行政违法行为检察监督已成为行政检察新的“增长点”，在法律监督体系中发挥着越来越重要的作用，但由于尚处于“探索”阶段，行政违法行为检察监督在运行中面临线索发现难、调查核实难、监督效果落实难三大困境。为破解监督难题，充分发挥行政违法行为检察监督制度优势，武汉市汉阳区人民检察院主动适应数字化时代发展趋势，深入践行数字检察战略，坚持“业务主导、数据整合、技术支撑、重在应用”的数字检察工作战略，结合办案实践和汉阳实际，积极探索大数据赋能行政违法行为监督高质量发展路径，通过协同治理、拓展信息贯通、扩大检察大数据队伍、培育典型案例等多种方式，实现行政检察内外协同配合、信息共建共享，促进综合素能全面提升、监督效能不断扩大，为数字检察如何助推行政违法行为监督提交了实践样板。
• In recent years, procuratorial supervision of administrative violations has become a new “growthpoint” of administrative violations, playing an increasingly important role in the legal supervision system, butbecause it is still in the “exploration” stage, the operation of procuratorial supervision of administrative violationsfaces three difficulties: difficult to find clues, difficult to investigate and verify, and difficult to implementthe supervision effect. In order to solve the supervision problems and give full play to the advantages of theprocuratorial supervision system for administrative violations, the People’s Procuratorate of Hanyang Districtof Wuhan has taken the initiative to adapt to the development trend of the digital era, deeply implemented thedigital procuratorial strategy, adhered to the digital procuratorial work strategy of “business leadership, dataintegration, technical support, and emphasis on application”, and combined the case handling practice with theactual situation of Hanyang. Actively explore the path for the high-quality development of the supervision ofadministrative violations enabled by big data, and achieve coordination and information co-construction andsharing within and outside administrative procurators through various ways such as collaborative governance,expanding information interconnection, expanding the procuratorial big data team, and cultivating typicalcases, so as to promote the overall improvement of comprehensive capabilities and the continuous expansion ofsupervision efficiency. A practical model is presented for how digital prosecution can promote the supervision ofadministrative violations.
