检察机关技术性证据审查：实践检视与理论反思

• 摘要： 在日益强调以庭审为中心的审判模式下，为了应对实践中层出不穷的技术性证据，充分发挥检察监督功能，检察机关技术性证据审查正扮演着日益重要的角色。梳理2018年至2022年409份以“技术性证据”为全文关键词的刑事判决书，不难发现，司法实践中检察机关技术性证据审查存在审查力量分布不均衡、审查类型过于单一化等实践困境。究其原因，主要是由于审查力量功能异化、审查标准体系不完备等现实及制度难题导致。对此，需要通过重视技术性证据审查的基层配置、坚持技术性证据审查的智慧化建设等方式加以完善，以期实践更加可行、制度更加健全、理论更加完备的技术性证据审查方案。同时，提高检察机关技术性证据审查工作效能，还需要加强检察监督，提高思想认识。
• In the increasingly emphasizing trial centered trial mode, in order to cope with the constantly emergingtechnical evidence in practice and fully play the role of procuratorial supervision, the review of technical evidenceby procuratorial organs is playing an increasingly important role. It is not difficult to find that in judicial practice,there are practical difficulties in the examination of technical evidence by procuratorial organs, such as unevendistribution of examination power and too single examination types, by reviewing 409 criminal judgmentsfrom 2018 to 2022 with the keyword “technical evidence” as the full text. The main reason for this is due tothe alienation of the function of the review power, incomplete review standard system, and other practicaland institutional difficulties. In this regard, it is necessary to improve the technical evidence review plan byemphasizing the grassroots configuration of technical evidence review and adhering to the intelligent constructionof technical evidence review, in order to achieve more feasible practice, sound system, and more complete theory.At the same time, to improve the efficiency of the technical evidence review work of the procuratorial organs, it isalso necessary to strengthen procuratorial supervision and improve ideological awareness.
