论未成年人刑事案件侦查分流机制的构建

• Abstract: 司法分流制度对未成年犯罪嫌疑人的保护具有重要意义，完善的司法分流制度应该是多主体参与并贯穿司法各个阶段。目前，我国已经在审查起诉阶段和审判阶段建立了司法分流制度，但是在侦查阶段却处于缺位状态，这无疑会使司法分流的效果大打折扣。为了完善我国的司法分流制度，应对侦查分流制度的可行性和制度价值进行分析，并在此基础上从适用条件、调查评估、监督与救济以及配套措施等方面构建侦查分流制度。
• The judicial diversion system plays an important role in the protection of juvenile suspect. A perfect judicial diversion system should involve multiple subjects and run through all stages of justice. At present, China has established a judicial diversion system in both the review and prosecution stage and the trial stage, but the diversion in the investigation stage is in a state of absence, which will undoubtedly greatly reduce the effectiveness of judicial diversion. In order to improve China's judicial diversion system, it is necessary to learn from foreign experiences and construct China's investigative diversion system from the feasibility of system establishment, system value, application conditions, supervision and relief, and supporting measures.
