• 摘要： 刑事远程审判作为信息时代智能司法背景下的新发展，当前仍存在着制度体系混乱、冲击直接言词原则、缺少对被告人权利的充分保障、削弱庭审仪式感与司法权威等问题，这些问题影响了审判程序的价值实现。为全面推进审判体系与审判能力现代化，应当以公正高效权威理念为指引，通过立法统一规范、贯彻庭审实质化要求下直接言词原则的本质内涵、充分发挥线上庭前会议功能、推进落实刑事远程审判下律师辩护全覆盖、遵守庭审环境与纪律要求等方面的制度建构，深化新时代司法体制综合配套改革，努力实现更高水平的数字正义，确保审判程序的双重价值得以实现。
• As a new development under the background of intelligent justice in the information age, the remote criminal trial still has some problems at this stage, such as the confusion of the system, the impact on the direct verbal principle, the lack of adequate protection for the rights of the defendant, and the weakening of the sense of trial ceremony and judicial authority, which aἀect the realization of the values of the trial procedure. Since the 20th National Congress of the Communist Party of China, in order to comprehensively promote the modernization of the trial system and trial capacity, we should take the idea of fairness, eḀciency and authority as the guide, through uniᴀed legislation, implement the essential connotation of the principle of direct speech under the substantive requirements of court trials, give full play to the function of online pre court meetings, promote the implementation of the full coverage of lawyers’ defense under the remote criminal trials, and comply with the requirements of court environment and discipline, Deepen the comprehensive reform of the judicial system in the new era, strive to achieve a higher level of digital justice, and ensure the realization of the dual value of the trial procedure.
