碳汇标准在生态责任恢复性司法措施中的应用

• 摘要： 我国提出于 2030 年实现碳达峰，2060 年实现碳中和的“双碳”目标对于完善生态环境治理体系、建设美丽中国具有重大战略意义。在此背景下，我国高度重视环境保护与恢复工作。法治作为生态文明建设的基本保障，在推进生态文明建设中扮演着重要角色，虽在当前环境司法实践中融入了越来越多的生态恢复性措施，但在环境保护的法律规制中仍存在法律责任的承担倾向于惩罚性措施，恢复性司法在环境犯罪司法实践中适用范围小等问题，究其原因主要在于司法实践中生态恢复性措施缺乏统一的适用标准。据此，亟需创新生态环境保护机制，引入碳汇概念，将其纳入生态恢复性措施的体系中，完善环境恢复性措施适用碳汇标准的法律依据，同时制定相应实行程序并加强监督管理，创建专门的环境恢复机构，最大程度上保证受损生态环境得到修复。
• China has committed to peak carbon dioxide emissions before 2030 and achieve carbon neutrality before 2060, the “Double Carbon” goal is of great strategic significance for improving the eco-environmental governance system and building a beautiful China. As the basic guarantee of the construction of ecological civilization, the rule of law plays an important role in promoting the construction of ecological civilization. At present, more ecological restoration measures are applied to the practice of environmental justice. However, there are still many problems in the legal regulation of environmental protection, such as excessive use of punitive measures and the improper application of restorative justice. The main cause of these problems lies in the lack of uniform applicable standards of ecological restoration measures in judicial practice. Accordingly, it is urgent to innovate the mechanism of ecological environment protection, we can apply carbon sink standards to ecological restoration measures, and improve the legal basis for applying carbon sequestration standards to environmental restoration measures, and formulate corresponding implementation procedures and strengthen supervision and management, including create a specialized environmental restoration agency, to ensure the maximum extent of damaged ecological environment can be repaired.
