• 摘要： 大数据证据随着科技进步而产生，但对于这种新兴证明材料能否作为证据使用以及其证据种类的认定，现行法律规定对此还存在空白，在司法实践中也产生了一定程度的混乱。为应对此种情况，须进行大数据证据的证据属性及种类的探讨。首先，对大数据证据的探讨要从其概念入手，大数据证据和大数据及大数据技术有相似性又有不同。其次，证据法中一项证明材料要成为证据需具备证据资格，大数据证据的证据资格主要围绕关联性和客观性这两种证据属性展开。最后，法定证据种类的设定限制了大数据证据等具有多重证据形式的新兴证明材料，故要打破法定证据种类的桎梏，弱化对证据种类的要求。
• With the advancement of science and technology, big data evidence is produced, but there are still gaps in the current legal regulations on whether this emerging evidence material can be used as evidence and the identification of its type of evidence, and there is also a certain degree of uncertainty in judicial practice. confusion. In order to deal with this situation, it is necessary to discuss the evidence attributes and types of big data evidence. For big data evidence, we must first start with its concept. Big data evidence has similarities and differences with big data and big data technology. Secondly, in the Evidence Law, a piece of evidence needs to be qualified as evidence. The qualification of evidence for big data mainly revolves around the two evidential attributes of relevance and objectivity. Finally, the setting of statutory evidence types limits emerging proof materials with multiple forms of evidence, such as big data evidence. Therefore, it is necessary to break the shackles of statutory evidence types and weaken the requirements for evidence types.
