暴力袭警事件的生成机制与治理路径 —— 基于583 份判决文书的实证分析

• 摘要： 暴力袭警事件具有历史性和多发性，是当前我国社会急需解决的问题。对583 份判决文书的实证研究表明：暴力袭警事件地域分布广泛、方式多样、后果严重、袭警对象集中，亟须规范化治理。然而，当前治理机制不完善，约束力度不足。在实证研究基础上，探究了暴力袭警生成机制主要有：社会矛盾纠纷突出、警察职能泛化、警察执法权威下降、法治信仰的缺失、警察执法不规范、袭警成本过低。基于此，需要对暴力袭警事件进行综合治理，具体治理路径有：构建化解矛盾分流机制、重新定位警察职能、重塑警察执法权威、加强法治教育宣传、重视执法规范化建设、强化惩治力度。
• The violent attack on police is historic and multiple, which is an urgent problem in our society. The empirical study of 583 judgment documents shows that the violence attack police incident is widely distributed in different ways, the consequences are serious, the target is concentrated, and it is urgent to standardize the governance. However, the current governance mechanism is not perfect, constraints are insufficient. On the basis of empirical research, this paper probes into the formation mechanism of violence attack police: prominent social contradictions and disputes, generalization of police functions, decline of police law enforcement authority, citizens’ selective law-abiding, non-standard police law enforcement, and low cost of attacking police. Based on this, there is a need for a comprehensive investigation of violent police attacks The specific governance paths include: constructing the mechanism of resolving contradictions, repositioning the police function, remolding the authority of police law enforcement, strengthening the publicity of law enforcement education, attaching importance to the construction of law enforcement standardization, and strengthening the punishment.
