论司法鉴定与智慧检务制度对接的范式

- 摘要： 智慧检务模式下，检察机关的司法鉴定工作流程、办案模式均发生较大变化，原有的制度体系需要重新修订，因此司法鉴定与智慧检务的制度对接研究是一项亟待完成的工作任务。为有效完成此项工作，需要先期对司法鉴定与智慧检务制度对接的范式予以界定。范式是用来界定什么应该被研究，什么问题应该被提出，如何对问题进行质疑以及在解释我们获得的答案时该遵循什么样的规则。对范式的研究是下一步制度构建的基础。
- Under the mode of intelligent inspection, the work process and case handling mode of procuratorial organs have changed greatly, and the original system needs to be revised. Therefore, the research on the system connection of judicial appraisal and intelligent inspection is an unavoidable task. In order to effectively complete this task, it is necessary to define the paradigm of the docking of judicial appraisal and intelligent inspection system first. The paradigm is used to define what should be studied, what questions should be raised, how the questions are questioned and what kind of rules to follow when interpreting the answers we obtain. The study of the paradigm is the basis of the next institutional construction.
