Considering the judicial practice in China, the rate of expert witnesses appearing in courts is extremely
low, and most of them refuse to testify, which is not only difficult to guarantee the credibility of their opinions,
but also hinders the smooth proceeding of criminal proceedings, and also affects the exercise of the rights of both
parties, especially the defense. According to the current criminal law regulations in China, this article analyzes the
reasons, causes and legal consequences of experts who refuse to testify in court. Besides, it refers to and draws on
relevant extraterritorial legislation, aiming to improve and refine the relevant laws and substantive penalties for
our expert witnesses’ non-appearance in court, and to put forward some suggestions to improve the situation of
low attendance rate.
