印章印文样本的规范化路径 ——基于100 起印章印文司法鉴定的实证研究

• 摘要： 样本是鉴定的重要基础材料，其质量很大程度上影响着鉴定意见的质量。本文通过对100例印章印文鉴定案件的实证研究，发现在当前的印章印文鉴定实践中普遍存在着样本材料不规范现象，这种不规范表现在样本的性质、数量、状态等方面，其缘由既有制度的缺位，也有相关主体在认识上的偏颇。笔者随后结合实践提出解决方案：第一，编制印章印文鉴定样本材料参考目录，从制度层面落实样本材料的规范化；第二，充分发挥司法技术人员能动作用，做好对外委托鉴定工作质量把控；第三，严守司法鉴定准入门槛，进一步促进样本材料的规范化。
• Sample is an important basic material for identification, and its quality affects the quality of identification opinions to a great extent. Based on the identification of 100 cases of seal seal seal, It is found that there are some non-standard samples in the current seal seal identification practice, which is reflected in the nature, quantity and state of samples. The reasons are both the absence of the system and the bias of the relevant subjects in cognition. Then the solutions are put forward. Firstly, the reference catalogue of seal seal identification sample materials should be established to standardize the sample materials from the system level. Secondly, give full play to the active role of judicial and technical personnel, and do a good job in the quality control of external entrusted authentication work; Thirdly, strictly abide by the threshold of access to judicial expertise, and further promote the standardization of sample materials.
