论我国侦、控、审三机关间的刑事技术差距

On Criminal Technology Gap among Investigation Organization Procuratorate and Court of Our Country

• 摘要： 刑事技术贯穿于刑事诉讼始终，在侦查、起诉、审判中均发挥作用。侦控审三机关之间的刑事技术水平不相匹配，存在刑事技术代差，其特点为：无法避免，可以缓解；侦查领先，控审落后；程度浅显，容易忽略。我国在法学人才教育和法律人员培养中均表现出刑事技术代差。究其原因，既有刑事技术流向不可逆、三大机关职能分工不相同、横向沟通交流机制不存在的客观因素，也有主体人员刑事技术意识不够高的主观因素。可以通过多元学习平台、明确技术入庭理念、构建横向交流机制、提高人员意识方面化解技术代差，让侦控审三机关间的刑事技术代差协调发展，和谐存在。
• Criminal technology plays a significant role in whole criminal proceedding from investigation to prosecution then to judgement. However, The Criminal technology level among investigation organization、procuratorate and court is out of tune and forms technology gap. It cannot be avoided but can be alleviated. Investigation organization is ahead of Procuratorate and court. The gap is so small that easy to ignore. There is technology gap in personnel cultivating program and continuing education. Not only objective causes such as irreversible technology flow trend、different funcional assignment and deficiency system of lateral communication, but also subjective reason responsible for the criminal technology gap. By utilizing various learning platform、making clear technical idea in court、building lateral communication mechanism and enhancing prople’s consciousness can harmonize the criminal technology gap among three institution.
