家事审判改革背景下的家事调解制度

• 摘要： 我国家事纠纷案件数量居高不下，类型复杂多样，家事调解制度是解决家事纠纷的最有效方法。在家事审判改革的背景下，各地法院不断对家事调解制度进行实践探索形成了可供推广的经验，同时也发现了家事调解制度存在的问题。目前应继续总结实践经验为后续家事程序立法做好铺垫，将新时代枫桥经验融入家事调解制度，并树立新型伦理理念作为指引。
• The number of family dispute cases in China remains high, and the types of disputes are diverse and complex. The family mediation system is the most effective method for resolving family disputes. Against the backdrop of family trial reform, courts across the country have continuously explored practical innovations in family mediation systems, forming experiences that can be promoted nationwide, while also identifying problems within the system. At present, efforts should continue to summarize practical experiences to lay the groundwork for subsequent family procedural legislation, integrate the newera “Fengqiao Experience” into the family mediation system, and establish new ethical concepts as guiding principles.
