Since the formal implementation of the plea leniency system, there has been a debate on the standard of proof, and there are voices in both academic and practical circles advocating lowering the standard of proof for plea cases. Therefore, it is necessary to lower the standard of proof in plea cases. At the same time, a distinction should also be made between the facts of conviction and the facts of sentencing, and the standard of proof of the facts of conviction should not be changed due to changes in the type of case, while the standard of proof for sentencing facts may be appropriately lowered in cases of admitting guilt and accepting punishment.
