Comparative Perspective on the Application of Single-Judge Trial System in Second Instance Civil Proceedings in China

• Abstract: 随着我国将繁简分流改革试点的成果在《民事诉讼法》中予以确定，独任制的适用范围被扩张到民事诉讼的二审程序之中。就这一适用范围的扩张，无论是立法层面还是司法实践当中仍然存在着不少问题，如二审中独任制的适用范围过大、独任制与合议制的转换程序设置不合理等。为此，本文通过在纵向上和横向上对二审审判组织形式进行比较研究，最终选择以德国《民事诉讼法》中控告审中独任制的制度构建为参考，提出对我国民事诉讼二审独任制的完善建议。
• With the reform pilot results on streamlining the trial procedures being incorporated into the Civil Procedure Law of the People's Republic of China, the scope of application of the single-judge trial system has been expanded to the second instance civil proceedings. However, there are still many problems in the expansion of the scope of application, such as the excessively broad application of the single-judge trial system in the second instance proceedings and the unreasonable procedures for switching between the singlejudge trial system and the panel trial system. Therefore, this paper conducts comparative research on the trial organization forms in the second instance proceedings in a vertical and horizontal manner, and finally selects the system of single-judge trial in the accusation trial stage of the German Civil Procedure Law as a reference to propose suggestions for the improvement of the singlejudge trial system in the second instance civil proceedings in China.
