• Abstract: “无讼”思想是中国古代传统法律文化的重要特征之一，作为传统法律文化中的主流价值，无讼思想对中国古代乃至今天都产生了深远的影响。本文通过系统分析“无讼”的内涵、形成因素以及产生影响等方面，揭示“无讼”作为宝贵的传统法文化，应当如何进行创造性转化，激发其现代化潜能和当代价值，从而为新时代社会主义法治服务，促进社会主义社会和谐发展。
• The idea of “no litigation” is one of the important features of traditional legal culture in ancient China. As the mainstream value in traditional legal culture, the idea of no litigation has had a profound impact on ancient China and even today. Through a systematic analysis of the connotation, formation factors and impact of “no litigation”, this article reveals how “no litigation”, as a valuable traditional legal culture, should be creatively transformed to stimulate its modernization potential and contemporary value, so as to serve the socialist rule of law in the new era and promote the harmonious development of socialist society.
