网络民意对司法的影响 ——比较法视野中的江歌案和药家鑫案

• 摘要： 网络民意能够进行司法监督，推动实体公正，但是，网络舆论的非理性因素如果介入到司法活动中会对国家审判造成极大的压力。通过江歌案和药家鑫案的对比引出网络民意对其判决结果的影响，探讨中日网络民意的差异性，以及网络舆论与司法独立之间的冲突，尝试提出正确发挥网络舆论对司法积极影响的对策，以实现网络民意与司法活动的良好互动，在此基础上，进一步完善我国的司法体制，保障司法的公信力。
• Internet public opinion can carry out judicial supervision and promote substantive justice; however, the irrational factors of Internet public opinion can cause great pressure on national trials if they are involved in judicial activities. Through the comparison of Jiang Ge case and Yao Jiaxin case to draw out the influence of network public opinion on their judgement results, we explore the differences between Chinese and Japanese network public opinion, as well as the conflict between network public opinion and judicial independence, and try to put forward the countermeasures to correctly exert the positive influence of network public opinion on the judiciary, so as to realise the good interaction between network public opinion and judicial activities, and on the basis of which, we can further improve China’s judicial system and safeguard the credibility of the judiciary.
