• 摘要： 随着中国经济的迅速发展，家庭在商品买卖中的地位日益重要，而在市场也扮演着越来越关键的角色。在婚姻财产关系方面，夫妻间的债务是其中的一个重要方面。夫妻共同债务的形成对家庭的稳定和交易的安全产生了深远影响。通过对判决书的搜查、研究和整理，笔者发现在司法实践中，对于“夫妻共同债务”的认定缺乏明确的准则指引，这反映了法官可能会随意行使自己的主观判断，而这种情况已经影响了司法的统一性。鉴此，为了提高公民或当事人对“夫妻共同债务”认定规则的确定性和可预见性，本文以法院在判决中对“夫妻共同债务”的司法认定为出发点，结合民法和其他相关法律规范，梳理了“夫妻共同债务”各认定要件的司法判断思路，试图总结出法院在对“夫妻共同债务”进行认定时的审查思路和审查步骤。
• With the rapid development of China’s economy, the family has become increasingly important in the buying and selling of goods, while playing an increasingly crucial role in the marketplace. In terms of marital property relations, the debt between husband and wife is one of the important aspects. The formation of joint marital debts has a profound effect on the stability of the family and the security of transactions. Through searching, researching and collating judgements, the author has found that in judicial practice, there is a lack of clear guidelines on the determination of “joint marital debt”, reflecting the fact that judges may arbitrarily exercise their own subjective judgement, which has affected the uniformity of the judiciary. In view of this, in order to improve the certainty and predictability of the citizens or parties to the “joint debt” rules, this paper to the court in the judgement of the “joint debt” as a starting point, combined with the civil law and other relevant legal norms, sorting out the “joint debt” of the judicial judgement of each element of the “joint debt” ideas, and try to summarise the court in the “joint debt” when the determination of the review of the idea and the review of steps. The review steps are attempted to summarise the court's review ideas and steps in the determination of “joint debts”.
