论我国新型未成年人犯罪预防体系的建构 ——以新时代“枫桥经验”为视角

• 摘要： 随着邯郸霸凌事件冲上热搜，未成年人犯罪的问题再次成为人们关注的热点。结合司法实践来看，未成年人犯罪的主要原因常常与原生家庭、学校监管教育、司法惩戒力度警示性有限存在关联。而新时代“枫桥经验”恰恰与未成年人的犯罪预防问题工作逻辑相似，具有指导意义。因此未成年人犯罪预防工作的展开应当发挥运用好新时代“枫桥经验”，运用其与未成年人犯罪预防工作所主张的修复性司法二者内在的关联性，从实际出发，采取进一步推广亲职教育、联动多方力量加强对未成年人的法治教育、建立不良信息收集机制，以及由检察机关牵头做好对未成年人的保护工作，多方协力筑牢未成年人犯罪预防体系。
• With the Handan bullying incident on the hot search, the problemof juvenile delinquency has once again become a hot topic of concern.Combined with the judicial practice, the main cause of juvenile delinquency isoften associated with the family of origin, school supervision and education,judicial disciplinary efforts warning limited. And the new era “the FengqiaoModel” precisely with the juvenile crime prevention work logic is similar,has guiding significance. Therefore, the work of juvenile crime preventionshould make good use of the “the Fengqiao Model” of the new era, and usethe inherent correlation between it and the restorative justice advocated byjuvenile crime prevention, and from a practical point of view, take measuresto further promote the parental education, linkage of multi-party forces tostrengthen the rule of law education for minors, establish a mechanism for thecollection of undesirable information, as well as a mechanism for the collectionof undesirable information by the prosecutors. To take a practical approach byfurther promoting parenting education, linking the efforts of various parties tostrengthen education on the rule of law for minors, establishing a mechanismfor the collection of undesirable information, and having procuratorial organstake the lead in improving the protection of minors, so as to build a solid systemfor the prevention of juvenile crime.
