The history of labor relations can be traced back to thousands of years,and it is also complex and changeable. This paper discusses the definition andcharacteristics of labor service in order to distinguish it from the contractingrelationship. The contract itself needs to provide certain labor services, so it isimpossible to distinguish between the contract and the labor services only fromthe perspective of the completion of labor services. The characteristics of thecontract relationship and the labor relationship are very similar, but the legaleffects of the two relationships are different, and the employer’s responsibilitiesare also different. If the legal responsibility is not clear enough, there will alwaysbe problems in judicial practice.
