风险社会视野下的行政训诫适用边界

• Abstract: 行政训诫作为非行政处罚的措施之一，在实践中经常被行政机关用以规制行政相对人的行为。虽然法律上对训诫有明文规定，但其适用的法律效果及空间并不明确，这导致行政训诫在行政管理中被滥用。目前理论界的研究成果大多侧重于对训诫行为性质的分析讨论，较少对该行为适用空间进行分析。以对法律规定和实践案例的分析为切入点，从实质意义上区分警告、责令改正等与行政训诫类似的行为，构建行政训诫适用的法律效果及适用空间。
• As one of the measures of non-administrative punishment,administrative admonishment is often used by administrative organs toregulate the behavior of administrative counterparts in practice. Althoughthere are explicit provisions on admonishment in law, the legal effect andspace of its application are not clear, which leads to the abuse of administrativeadmonishment in administration. Most of the current theoretical researchresults focus on the analysis and discussion of the nature of the admonishmentbehavior, and less on the analysis of the application space of the behavior. Thispaper takes the analysis of legal regulations and practical cases as the entrypoint, distinguishes the behaviors similar to administrative admonishment suchas warning and ordering correction in the substantive sense, and constructs thelegal effect and application space of administrative admonishment application.
