• Abstract: 国际豁免理论研究关乎国家利益。明确国家概念是理解国家豁免的基础。 国家本身不能进行活动，代表国家表达意志的主体是国家豁免的主要对象。国 家豁免理论包括绝对豁免主义和限制豁免主义，限制豁免主义在当今世界上越 来越得到认可。国家从事侵权行为和商业行为时不得原因国家豁免与主权平等 原则不矛盾。国家既是豁免的给予者，也是豁免的受益者。
• State immunity is linked to national interests. It is fundamental to clarify the definition of the state. The representatives of the state acting on behalf of its benefit is the subject of state immunity, for they interact with foreign countries and share their viewpoints. State immunity consists of absolute state immunity and restrictive state immunity. Now, restrictive state immunity is getting international acceptance. Exceptions of state immunity is demonstrated in the infringement acts and the commercial conducts for the principle of sovereignty equality is not contrary to the state community. The state is the giver for the immunity but also the receiver.
