摘要：只有在市场经济条件下，产权才能有别于传统的所有权而成为内涵丰富的有机的权利约束，才能有别于封建时代的等级特权而成为平等的法权。只有建立和维护有效的产权制度，市场经济才能实现对资源合理有效的配置。在市场经济条件下，产权离不开法律的保护。从法律角度来说，法对产权有内在的、本质的要求。
Only under the condition of market economy can property rights be different from the traditional ownership and become the organic right constraint with rich connotation, and be different from the hierarchical privilege in feudal times and become the equal legal right. Only by establishing and maintaining an effectiveproperty right system can market economy realize rational and effective allocation of resources. Under the condition of market economy, property right cannot leave the protection of law. From the perspective of law, law has inherent and essential requirements on property rights.
