浅议离婚冷静期制度

• 摘要： 社会生活百科全书——民法典的颁布引起了人民群众的广泛关注和热烈讨论，大家对婚姻家庭编中新增的离婚冷静期制度反响尤为强烈，反对的声音不绝于耳。离婚冷静期的适用范围应限于登记离婚，既是立法原意也是正当解读。诉讼离婚的程序中已暗含冷静时间，无需适用离婚冷静期。离婚冷静期与离婚自由并非对立关系而是相辅相成。通过对国内外的实践经验的总结，我国未来应当增加离婚冷静期的相关配套措施，并且可以设置灵活的冷静期间，将减少轻率离婚、维护婚姻家庭的目的真正落到实处。
• The promulgation of the Civil Code, an encyclopedia of social life, has aroused widespread concern and heated discussion among the people, especially the response to the new system of divorce cooling-off period in the compilation of marriage and family, there was a lot of opposition. The application scope of the cooling-off period of divorce should be limited to the registration of divorce, which is not only the legislative intention but also the proper interpretation. The divorce proceedings have implied a cooling-off period, there is no need to apply a cooling-off period for divorce. The cooling-off period of divorce and the freedom of divorce are not opposite relations but complement each other. Through summing up the practical experience at home and abroad, our country should increase the relevant supporting measures of divorce cooling-off period in the future, and can set up flexible cooling-off period, the aim of reducing frivolous divorce and maintaining marriage and family will be realized.
