• 摘要： 马克思主义理论对中国革命和建设发挥了全面指导作用，中国的法制建设也始终在马克思主义法学指导之下进行。无论在中国法制建设初期还是在改革开放时期，对于究竟是学习、移植西方法律制度还是建立自己独特的法律制度，一直存在争议，正是在马克思主义法学的立场、方法的指导下，法学研究和立法者树立了中国社会主义法治理念，初步建设完善了社会主义法制体系。
• Marxist theory has played a comprehensive guiding role in China's revolution and construction, and China's legal construction has always been carried out under the guidance of Marxist law. At the beginning of the Chinese legal system construction or in the period of reform and opening-up, there is to learn, transplant of western legal system and to establish its own unique legal system, has been controversial, it is in the position of marxist jurisprudence, method, under the guidance of legal research and lawmakers to set up the socialist concept of rule of law in China, the preliminary construction to perfect the socialist legal system.
