• 摘要： 目前法学界对专家辅助人诉讼地位的讨论各执一词，一些学者期待通过法律移植，将英国专家证人（Expert witness）本土化；一些学者通过实证分析专家辅助人出庭顺序，从而确定其证人地位；另一些学者通过统计调研法官、律师、检察官等对专家辅助人地位的看法，整合数据后得出其“类似于鉴定人”的地位。但继续脱离实体法，对专家辅助人法律制度构建和假设的意义已经不大，笔者转换思路，通过对专家辅助人参与的 108 个案件归纳整理，首先明晰专家辅助人意见在庭审中的实际作用、明显特征，继而定义其意见性质，反推出专家辅助人在我国立法中应当处于何种诉讼地位，进而为专家辅助人制度提供新的改革路径。
• At present, the legal circles have different opinions on the litigation status of expert assistants. Some scholars are looking forward to the localization of British expert witnesses through legal transplantation; some scholars determine their witnesses through empirical analysis of the appearance order of expert assistants Status: Some scholars use statistics to investigate judges, lawyers, prosecutors, and other opinions on the status of expert assistants, and then integrate the data to arrive at the status of “similar to an expert.” However, continuing to deviate from the substantive law is of little significance to the construction and hypothesis of the expert assistant’s legal system. The author changed her mind and summarized and sorted out 108 cases involving the expert assistant, first of all, to clarify the actual role of the expert assistant’s opinion in the court trial. , The obvious characteristics, and then define the nature of its opinions, and infer what kind of litigation status the expert assistant should be in the legislation of our country, and then provide a new reform path for the expert assistant system.
