• Abstract: 我国在新修改的《专利法》中首次引进了专利开放许可制度，而条文中缺乏对适用条件的规定，因此明确开放许可制度的适用条件成为亟待解决的问题。首先，应明确申请主体包含专利权人和专利申请人。其次，在许可撤回过程中可以通过预告撤回和限缩解释“专利实施期间”的方式保护潜在被许可人的信赖利益。最后，在明确开放许可声明属性为要约的基础上，采用“开放—普通许可”二分的开放许可成立路径，以帮助该制度在我国更好地运行。
• The latest “Patent Law” in China introduced the patent open license system for the first time, but there is no stipulation on the applicable conditions in the provisions, so it has become an urgent problem to clarify the applicable conditions of the open patent licensing system. First, it should be clear that the subject of the application includes the patentee and the patent applicant. Secondly, in the process of license withdrawal, the reliance interest of potential licensees can be protected by means of advance notice withdrawal and limited interpretation of the “patent implementation period”. Finally, on the basis of clarifying the attributes of the open license declaration as an offer, a two-part open license establishment path of “open-general license” is adopted to help the system operate more efficiently in Chinese current patent trading market.
