示范诉讼探析 ——兼论与我国代表人诉讼的关系

• Abstract: 经济社会的快速发展使解决群体性纠纷的形式多样化，我国除了适用代表人诉讼 外，实践中还有不少示范诉讼的运用。通过对示范诉讼的基础理论的梳理，论 证了示范诉讼在多元纠纷解决路径中特有的价值功能。在厘清登记程序的效果、 代表人和示范案件的选择、审理方式、判决效力、与代表人诉讼的关系后，尝 试从宏观层面提出按照人数数量是否确定和纠纷范围，选择或结合适用示范诉 讼和代表人诉讼的方案。
• With the rapid development of economy and society, the forms of solving group disputes are diversified. In addition to the application of representative litigation in China, there are many application of model litigation in practice. By combing the basic theory of the Test litigation, this paper demonstrates the unique value function of the Test litigation in the multiple dispute resolution path. After clarifying the relationship between representative litigation and the effect of registration procedure, the choice of representative and Test cases, trial mode and judgment effect, this paper tries to put forward the scheme of applying Test litigation and representative litigation according to whether the number of people is determined and the scope of dispute from the macro level.
